Chapter 9 addresses the possibility of mediation, conciliation, and other non-litigious forms of alternative dispute resolution. Other topics covered are conciliation and investment treaties, the hybrid practice of mediation-arbitration, choosing a conciliator or panel of conciliators, and an analysis of why conciliation is not more frequently used in investment disputes.
