Whether Slovenia had met its obligations to Hrvatska Elektroprivreda DD (‘HEP’) under the Agreement between the Government of the Republic of Croatia and the Government of the Republic of Slovenia on Regulation of Status and Other Legal Relations Regarding the Investment, Use and Dismantling of Nuclear Power Plant Krško (19 December 2001) by extending two offers to HEP for delivery of electricity in 2002. — Whether HEP should have accepted Slovenia’s 2002 offers for electricity delivery in order to mitigate its losses. — Whether HEP had passed on any additional costs to consumers and therefore suffered no loss. — Whether HEP had received any benefit that it would not have received had Slovenia met its obligations that needed to be taken into account in the calculation of damages.
